We make reasonable efforts to display accurate product descriptions, images, and pricing, including for planters, fencing, artificial plants, compost, stepping stones, water butts, and live plants. However:

• Colors and appearance may vary slightly from what is shown on your screen;
• Live plants are natural products and may vary in size, shape, and appearance from photos;
• We reserve the right to correct any pricing or description errors, even after an order has been placed, and will contact you before processing an order affected by such an error; and
• Prices are subject to change without notice, but the price charged will be the price displayed at the time you complete your order.

4. Orders and Acceptance

Placing an order on our website is an offer to purchase, which we may accept or decline. An order confirmation email does not guarantee acceptance — we reserve the right to refuse, cancel, or limit any order for reasons including suspected fraud, pricing or inventory errors, or unavailability of stock. If we cancel an order after payment has been taken, you will receive a full refund.

5. Payment

Payments are processed securely through Stripe. By placing an order, you confirm that you are authorized to use the payment method provided. Applicable sales tax will be calculated and added at checkout based on your shipping or billing address as required by law.

6. Shipping and Delivery

Shipping costs, carriers, processing times, and delivery estimates are described in our Shipping Policy. Live plants are available for local in-store pickup only and are not shipped — see our Shipping Policy for full details.

7. Returns, Refunds, and Cancellations

Returns, exchanges, refunds, and order cancellations are governed by our Refund and Returns Policy, which forms part of these Terms.

8. Live Plants — Additional Terms

Live plants are sold as-is at the time of pickup. We encourage customers to inspect live plants before leaving the store, as our return process for live plants is limited (see our Refund and Returns Policy). Care instructions provided by our staff or on plant tags are general guidance; plant health after purchase depends on care, environment, and conditions outside our control.

9. Intellectual Property

All content on our website — including text, graphics, logos, product photos, and the Davison’s Nursery Inc name and branding — is owned by us or our licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or use our content for commercial purposes without our written permission.
